DANGEROUS TIME OF YEAR FOR DRIVERS AND DEER

State Farm has released its annual deer-related collision report, and Pennsylvania is again listed as the fifth most likely state for a deer collision.  Pennsylvania drivers have a 1 in 77 chance of hitting a deer this year.  Even though the odds seem good, State Farm has reported that the odds of colliding with a deer are actually down by 4.3 percent.  The reason for the decline is simple.  There are more registered drivers on the road.
State Farm compiled these numbers by look at the total number of deer collisions between July 1, 2012 and June 30, 2013, and found that 1.22 million deer-related collisions occurred during that period, which they say is down by 3.5 percent compared to the previous year.  State Farm also reports that November is the most likely month for an incident to occur, followed by October and December.
State Farm has reported that the “Top 5 Most Likely States for Deer Collisions” are as follows:  1) West Virginia; 2) Montana; 3) Iowa; 4) South Dakota; and 5) Pennsylvania.   State Farm has also provided tips for deer safety:
1.       Be aware of posted deer crossing signs, which are placed in active deer crossing areas.
2.       Deer are most active from 6-9 p.m.
3.       Use high beams headlamps as much as possible to watch for deer at night.
4.       Do not be a distracted driver.  Using cell phones and eating while driving may cause a driver to miss seeing a deer until it is too late.
5.       Deer typically travel in groups, so if you see one it’s likely there are more

Dangers of Shift Work

Article taken from ABC.com, By STACEY SCHOTT, M.D., ABC News Medical Unit  on July 26, 2012:

"More bad news for late-shift workers: Their odd hours may be raising their risk of heart attack and stroke.
So says a new, large-scale study in the British Medical Journal that adds these two problems -- which fit into a broader category known as vascular disease -- to the previously known risks of shift work. Previous research had suggested that working the graveyard shift, the swing shift or any irregular shift other than the traditional 9-to-5 is linked to high blood pressure, diabetes and obesity.
British and Canadian researchers analyzed the findings of 34 studies that included more than 2 million people who had work schedules including anything other than regular daytime hours. They found that shift work was linked to a 23 percent increased risk of heart attack and a 5 percent increased risk of stroke. Those working night shifts seemed to be at the highest risk.
The study authors said it pays for workers to know that their jobs may put them at increased risk.
"The increased risk of vascular disease apparent in shift workers, regardless of its explanation, suggests that people who do shift work should be vigilant about risk factor modification," they wrote in the report.

A variety of factors -- not just the shift work itself -- could be culprit in increasing the risk of heart attack and stroke for people in those occupations. A lack of sleep, poor eating habits and lower levels of physical activity could plague those who work irregular hours and drive up the risk of vascular disease.
Dr. Robert Bonow, professor of medicine at Northwestern University Feinberg School of Medicine and past president of the American Heart Association, said it's possible that people working jobs requiring shift work may be economically disadvantaged and have less access to health care -- two factors generally associated with unfavorable health outcomes.
However, the study authors noted that the increased risk of vascular events was still present even when they accounted for things like unhealthy eating, smoking and socioeconomic status -- evidence that something about the nature of shift work other than poor health behaviors might be at play.
But what could it be? One possibility is disruption in circadian rhythm, a feature inherent in shift work. These disruptions can certainly have an effect on heart rate and blood pressure -- two measures intimately tied to vascular health, said Dr. Carl Lavie, a cardiologist at Ochsner Medical Center in New Orleans.
Since shift work is a necessary evil for more than a third of the working population, it is unreasonable to think that everyone can simply change their schedules.
"My advice would be to exercise and make sure their fitness is at a high level, and then I'd treat their risk factors vigorously," Lavie said. He added that if you are a shift worker it is important to recognize that treatments you might be getting for blood pressure control, weight control and cholesterol may be more important for you than someone at a lower risk.
Bonow agreed. "There's somewhat of a signal here, and people who do shift work should be aware that their risk factors should be identified and managed." "

Not only does shift work increase the risk of heart attack and stroke, it can also lead to severe fatigue.  Consequently, shift workers may be more likely to cause or be involved in motor vehicle accidents. If you were involved in a motor vehicle accident due to the fault of another, it may be time to consider consulting an attorney.  Attorney Doug Stoehr specializes in motor vehicle accidents in western and central Pennsylvania. Teenage Driving By The Numbers

For a teenager, finally getting your driver’s license is an exciting milestone in your high school life.  With their own license, teenagers are able to have more freedom to visit their friends, attend sporting events, and participate in activities and events around town.  Although getting a driver’s license is a fun and exciting time, teenage drivers can also be more likely to cause or be involved in serious accidents.  Teenage drivers are sometimes more reckless with their driving, including driving while using their phone, texting behind the wheel, speeding, or disobeying the rules of the road.

As mentioned above, new and inexperienced teenage drivers are much more likely to be involved an accident that will harm themselves and/or others.  Take a look at the following statistics and facts regarding teenage drivers and automobile accidents.  According to the CDC:

·       Motor vehicle crashes are the leading cause of death for U.S. teens, with more than one in three deaths in this age group.
·       Teens are more likely than older drivers to underestimate dangerous situations.
·       In 2009, eight teenagers aged 16 to 19 died every day from automobile accident injuries.
·       For every mile driven, teen drivers aged 16 to 19 are four times more likely than older drivers to crash.
·       In 2008, 1/4 of drivers aged 15 to 20 who died in car crashes had a blood alcohol level of 0.08 or higher.
·       Teens are more likely than older drivers to speed and allow shorter headways (distance between cars).

If you or a loved one have been injured or another has been killed as the result of a new and inexperienced driver, it may be time to take legal action.  Although not all teenagers are poor drivers, there are many instances at which a new driver may be at fault for an accident or injury.  If you would like more information about this page or Attorney Stoehr’s areas of practice, contact our Altoona, Pennsylvania, law firm.

Texting Teen Dies In Car Crash

Yesterday, a Butler County teenager died in a car accident.  Alexis Summers, a 17-year-old teenager from Saxonburg, PA was texting while driving when she drove over an enbankment.  Her car crashed into a tree near the road and Summers died at the scene.  This accident occured on the same day that the legislation officially passed in the Pennsylvania State Senate which bans texting while driving. Both the Pennsylvania State Senate and House of Representatives have been in conversation since June about the possibility of banning texting while driving, making it a primary offense in the state.  Once Governor Corbett signs the legislation, the law will take effect after 120 days.

Distracted driving is one of the major causes of motor vehicle accidents, especially with young and inexperienced drivers. Distracted drivers may also swerve off the road, hitting stop signs, telephone poles, and most seriously, other people walking or biking. Additionally, they are a danger to others in the car with them, since they may cause an accident in which the passengers in their car are also injured.  Attorney Doug Stoehr is a personal injury lawyer serving the western and central Pennsylvania area.  One of his major areas of practice is injury or death due to motor vehicle accidents.  He has noticed a trend of accidents involving cell phone usage, either talking or texting, and urges you not to use your phone while driving and be wary of other drivers on the road who may be using their phones.  For more information on his law firm, please click here.

Driver In Court For Semi-Truck Accident

A semi-truck driver who caused  a six-car accident in the greater Philadelphia area in currently undergoing trial for falsifying driving logs.  Valerijs N. Belovs was driving a large commerial truck in early 2009 when he caused a large accident claiming the life of a Fort Washington businessman.  Belovs had falsified his driving record fifteen separate times around the time of the accident in order to get less sleep and drive more hours, breaking federal rules and regulations.  According to the United States Department of Transportation,  truck drivers should not exceed the eleven hour maximum allowable daily driving hours without having rested or being off-duty for ten consecutive hours.  On the day of the accident, Belovs was driving in the Philadelphia area and came around a bend where cars were slowed down.  Due to faulty brakes, Belovs was unable to slow down his truck and, consequently, caused a six car pile-up.  Belovs had reported brake problems to his superiors multiple times, but was told to use the emergency brake on his trip until he had finished his delivery across the country to California.  His superior also supplied him with stickers stating that the truck had been inspected and passed all inspections, when in reality it had not been inspected at all.  Both Belov's superior and the person who had supplied the false inspection stickers were also jailed.

Commercial truck drivers are a significant cause of motor vehicle accidents . Often, these commercial drivers are fatigued and are driving above the mandated allotment of hours. Additionally, many of them are driving large vehicles that are not up to federal and state safety standards. As a result, passengers and other vehicles often bear the brunt of their illegal activity and are often seriously injured or die from a resulting collision. If you have been injured or a loved one has died as a result of a commercial vehicle accident, please contact our law office for a consultation at no cost to you at the Law Offices of Attorney Doug Stoehr.

Teen Driving Bill Moves On To Governor

New drivers and teenage drivers in Pennsylvania are seeing many new changes come into effect after the passing of a House bill today.  State representatives voted in the House this week to approve many changes to Pennsylvania's driving laws as they apply to teenage and new drivers.  Some of the major changes that will take effect once Governor Corbett signs the bill into law (which he states that he intends to do)  are:

-For the first six months after a new driver receives their license, they are not allowed to carry more than one passenger in the car if a parent is not present.  After the driver has been accident-free for six months, the passenger limit increases to three passengers.
-For drivers and passengers under the age of 18, failure to wear a seatbelt will be made a primary offense.  This means that a police officer can pull over a teen driver for not wearing their seatbelt, even if they are obeying all other traffic laws.
-The number of driving experience hours to receive a permit will be 65, which is a significant increase of the previous amount (50 hours).  10 of those hours must be night driving, and 5 hours should be in inclement weather conditions.

Inexperienced driving is a major component in many motor vehicle accidents. Teenage drivers are arguably the most likely group to cause a car accident, due to a lack of experience, a tendency to talk on their cell phones and text while driving, and distractibility by other friends in their vehicle. Our law office hopes that these changes in driving laws will lead to a decrease in accidents and will result in more responsible and experienced teenage drivers.

Common Chronic Pain Disorders

Chronic pain, the theme of this blog for the past week, is often a blanket diagnosis used to explain pain that persists consistently over a period longer than 3-6 months.  However, chronic pain can result from many different disorders and injuries.  Below please find the more common disorders associated with chronic pain, courtesy of About.com. Unfortunately, many of these problems come from common accidents, such as motor vehicle accidents or slip and falls.

Chronic pain can frequently come along with a back injury.  The major back injuries that can lead to chronic pain are slipped/bulging discs, spinal stenosis, compression fractures, soft tissue damage, traumatic fractures (such as from accident or crash injuries), or diseases like lordosis and scoliosis.  Additionally, headaches (such as migraines and cluster headaches) and joint pain (rheumatoid arthritis, repetitive strain injury, and osteoarthritis) are also major sources of chronic pain.

As mentioned in my blog post earlier this week, a subset of chronic pain is neuropathic pain.  This type of pain involves problems with nerve endings, not musculoskeletal problems.  Common sources of neuropathic chronic pain are sciatica, bulging/slipped discs (leading to nerve compression in the spinal cord and the immediate surrounding area), diabetic neuropathy, and carpal tunnel.  Unfortunately, not a lot is known about neuropathic pain and effective treatments are still being researched and developed.

Chronic pain can take many forms, but the important thing to remember is that this pain should not be ignored or underestimated.  If not properly treated by a trained physician, it most likely will remain the same or worsen over time.

Semi-Truck Drivers Using Cell Phones on the Job

Cell phone use while driving is irresponsible, reckless, and a threat to the safety of the driver, their passengers, and other vehicles on the road.  Most drivers recognize these facts, however, many still choose to ignore safety laws and continue to text and talk on their cell phone while on the road.  Drivers of cars are not the only people who are guilty of not obeying the safety laws; semi-truck drivers have also been caught using their cell phones while driving.  As startling as this phenomenon seems, it is not uncommon on the highways.  As a result of this and in response to a recent semi-truck accident that was supposedly caused by a truck driver on his cell phone, the National Transportation Safety Board hasrecommended banning the use of cell phones for truckers nationwide (except foremergency purposes).   The recent accident, cited by the NTSB as a possible reason for cell phone bans for truckers, involved a truck driver who was talking on his phone while driving and caused an accident that killed 11 people.  Directly before the accident, the driver made a call and crossed a median on an interstate, crashing into a van carrying twelve people that were coming home from a wedding.

Spinal Cord Injuries--Statistics and Causes

Spinal cord, brain, and other serious injuries are frightening, life changing, and complicated to live with and treat.  A recent press release by the Shriners Hospital for Children offered up a few surprising and eye-opening statistics related to the prevalence and common causes of spinal cord injuries.  Their list included the following statistics:

-At least 30, if not more, American citizens every day are victims of a spinal cord injury that results in some form of paralysis
-There are over 12,000 new cases of spinal cord injury every year in the US
-About half of all spinal cord injuries occur higher up the spinal column (around the neck area), which affects the ability to breathe, as well as motor control and sensation in all four limbs
-Specifically for children, between 1,500 and 2,000 new spinal cord injuries are reported every year in the US
-Among the most commonly reported causes of spinal cord injuries, especially for children and teenagers, are motor vehicle accidents, diving accidents, trampolines, and falls.

Attorney Doug Stoehr knows how difficult it can be when you or a family member has suffered a debilitating spinal cord or brain injury.  His legal practice is focused solely on personal injury, including cases where severe spinal cord, brain, and other serious injuries have occurred.  He has successfully handled cases for clients involving motor vehicle accidents, premises liability, and falls; most recently, one of his cases involving severe brain injury settled for over $1.2 million dollars. Traumatic Brain Injury and Car Accidents

Yesterday, our blog posted an article about traumatic brain injuries (TBI) and the National Institute of Health’s initiative to start a $10M database for TBI research.  Stemming from that article, today we will be covering how TBI’s occur and debunk some myths about TBIs.  According to Dr. GlenJohnson, a clinical neuropsychologist, “It is important to note that you do not have to be traveling at a high rate of speed to get a head injury. Nor do you have to hit your head on an object (steering wheel, windshield) to injure the brain. Even at moderate rates of speed, traumatic brain injuries can and do occur.”
In the case of TBI due to a motor vehicle accident, I think it is a common misperception that brain injuries can only occur if you physically hit your head on a part of the car and/or that you must be travelling at a high rate of speed to do any significant damage.  Neither one of these things is true; in fact, you can be travelling at a relatively low rate of speed and still significantly damage your brain if you are hit by another car.  To put this in perspective:  if you are a passenger or driver in a car, going 25 miles an hour, and another car hits you from behind and your body propels forward, the impact from that accident may have a significant effect on your brain.  The brain would propel forward into your skull, going from your previous rate of speed, 25mph, to 0mph in a matter of seconds.  That impact may significantly damage some of the soft tissue of your brain, leading to lasting problems.  Additionally, in this situation, the head did not hit any other part of the car, such as a window or dashboard.
Keeping these things in mind, it is important to monitor your cognitive abilities after being in a car crash.  Look for your ability to remember events, procedures and people, as well as pain and stiffness of the neck and back.  Additionally, monitor frequency and intensity of any headaches, as well as problems with your 5 senses (hearing, touch, taste, smell, and sight).  A persistent or worsening problem in any of these areas may indicate the presence of possible brain trauma and should be look at by a physician.

Chronic Pain and Psychological Disorders

Often, chronic pain also has secondary, but not insignificant, repercussions that many do not consider.  One of these secondary issues is the development of psychological disorders; of this category, one of the primary disorders that may develop is depression.  According to an article by Harvard Health Publications (a division of Harvard Medical School),  “Pain, especially chronic pain, is an emotional condition as well as a physical sensation. It is a complex experience that affects thought, mood, and behavior and can lead to isolation, immobility, and drug dependence.”  Patients suffering from chronic pain are three times more likely to suffer from an anxiety or mood disorder than a pain-free counterpart.
Due to the knowledge of the intimate biological and psychological relationship between pain and depression pathways, some rehabilitation centers are working to treat the two disorders in tandem.  In addition to the traditional methods of physical therapy to relieve pain from injuries, cognitive/behavioral therapy and psychotherapy can work well to help heal the psychological damage that results from a significant injury.  Sometimes, families of those injured can also be a part of these psychological therapies, since they are also significantly affected by a serious injury.
Chronic pain frequently occurs as a result of a serious injury, such as a motor vehicle accident, slip and fall, or brain or spinal cord injury.  Attorney Doug Stoehr is an experienced trial lawyer who fights for those who have suffered significant person injury at the expense of another.  Attorney Stoehr primarily serves the central and western Pennsylvania area.  For more information about his law firm, please visit our website.

September is Pain Awareness Month

Unfortunately, many of Attorney Stoehr's clients have experienced sustained pain to one degree or another as the result of an accident.  According to the American Pain Foundation, September is National Pain Awareness Month.  Pain is said to affect more Americans than diabetes, heart disease, and cancer combined.  With this in mind, chronic pain is still a medical problem that many overlook or underestimate when making medical diagnoses.  It is extremely important to monitor your pain, especially after an accident, to see if the intensity and frequency of your pain is diminishing, or is something that needs to be seriously addressed by a professional.  This is also something that a caregiver or concerned family member could check in on in regards to their injured loved one, perhaps every day or certain times during the day.

Chronic Pain is More Prevalent Than You May Think

Chronic pain is an extremely debilitating and life-changing issues that a large number of Americans deal with on a daily basis.  According to the American Pain Society, 42% of American adults experience pain daily (chronic pain) and 89% experience pain monthly.  Nearly half of all Americans seek out a physician at least once a year for pain relief as a primary complaint.  If you consider those statistics in terms of raw numbers, that means that about 50 million Americans are living with chronic pain, and millions of others directly related to them that are dealing with their diagnosis along with the affected person.

With all that in mind, it is important to realize what a major effect chronic pain can have on day to day life.  It is all-encompassing and can prevent a person from spending time with their family, contributing to their community through daily work or volunteering, and make them unable to perform physical activities which they previously enjoyed.  Often, this chronic pain comes as a result of an accident, whether it be motor vehicle, slip-and-fall, brain or spinal cord injury, or countless other situations.  Attorney Doug Stoehr has worked with many clients who experience chronic pain as a result of an accident at the fault of another.  If you would like to contact our office to set up a free initial legal consultation, please click on the above link to reach us.

Most Dangerous Times To Be On The Road

As most of us know, there are periods throughout the year when it seems to be more dangerous than normal to be traveling in your car.  Forbes Magazine researched this phenomenon using statistics from AAA and the National Highway Safety Administration to figure out which times actually are statistically more likely to result in car accidents.  Their results?  August is the most dangerous month in which to drive, and Saturday is the most dangerous day of the week to drive, especially in the evening.  The reason was attributed to driver distractability, intoxication, and speeding.

Our law firm has seen several serious accidents involving driver fatigue and driver distractability, which led to severe injuries. While you may be responsible, safe, and focused on the road, this does not mean that everyone you are sharing the road with is as well. Defensive driving is especially important on truck-heavy roads and highways. If you have been in a motor vehicle accident and have suffered significant personal injuries, please contact our office for a free consultation.

"Minor" Injuries Can Do Major Damage

When a person is injured, whether it it's a car crash, slip and fall, or another situation, the hurt party may feel that their injuries are minor or not significant.  Although this is sometimes the case, sometimes seemingly minor injuries can develop into serious and major problems. Many people initially write off their injuries as minor aches and pains that will decrease over time, but unfortunately, this is not always true.

An article originally published by Newsweek magazine talked about an excellent example of this phenomenon.  In this story, a woman had suffered from a "minor head trauma" as a result of a bike accident.  Although she seemed on the road to recovery at the start, she talked about persistent problems that lingered as a result of her accident.  It now is more difficult for her to communicate with others, perform her job, and even write legibly.  Keeping this story in mind, it is important to monitor your mental and physical problems after an accident to see whether you are actually recovering or whether you need to re-evaluated by a physician for possible lingering and worsening problems.

Tour Bus Turns Over On PA Turnpike

A Greyhound bus driving on the Pennsylvania turnpike last week, near the Lancaster/Lebanon exit, turned over on its side.  The crash injured 24 passengers and left one woman trapped in the wreckage; 29 people total were on board, including the driver.  Police are investigating the cause of the crash.  Greyhound declined to comment on the driver's record and driving performance.

Tour bus and commercial truck drivers are a significant cause of motor vehicle accidents .

E-Legs In Action: Treatment for Spinal Cord Damage

Earlier in the summer, this blog touched upon a new treatment for people suffering from spinal cord injuries.  A new medical device called "E-Legs", originally developed by the military, is being used to help paralyzed clients walk on their own with the aid of a exoskeleton-like device.  A video was recently posted showing this device in action and also highlighted a human interest story about a patient trying out the new device after being confined to a wheelchair for over 15 years.  Hopefully this device will become more accessible and affordable for rehabilitation centers and hospitals to utilize in their treatment of patients with spinal cord damage.

Severe brain and spinal cord injuries, especially as a result of a motor vehicle accident, can be extremely debilitating and disheartening to experience and overcome. Attorney Stoehr has experience working with those suffering from brain and spinal cord injuries as a result of an accident at the fault of another. State Police Recognized for Good Crash Inspection Performance

The Pennsylvania State Police was recently recognized for provided accurate and timely data from crash scenes, as well as random inspections of truck and other commercial drivers.  They were recognized nationally by the U.S. Department of Transportation Federal Motor Carrier Safety Administration for their outstanding work in addition to their day-to-day work of enforcing roadside safety and state and federal driving laws.

The Pennsylvania State Police work very hard for our state's citizens, especially on site at crash scenes.  Motor vehicle accidents occur suddenly and can be overwhelming for an accident victim.  The State Police do an excellent job of assessing the crash scene while helping to get accident victims the medical assistance that they may need. Their crash report may also become important if a crash victim decides to open a personal injury claim accident against the person who caused the accident.
